Lol.It would also be nice not to get an error message that the person is "busy and doesn't want to talk to you" but rather make it send a nicer message as to "This person is not available at this moment."
This is a nice idea though, it'll help.

Well if a user is away busy or offline and you try to talk with them it won't allow you. So this may void the suggestion a little bit.
Most people either forgets, or don't set themselves so, and goes offline. In such cases, it really is frustrating to wait for a reply as KP said.
Edit: About the second part of your idea Nana: I think it would be best if the error displayed the following message. "You message could not be sent to the ___ user because he/she appears to be offline."
And I don't really think WoN has the capability to do that. I mean, the problem is minute to include a "send message to pm" button. But it would be nice if the sent messages are available for the person to see when he comes online.

But this could be so much more annoying too, I guess. Some people might not want to be disturbed with stuff like "game-loss" rages. Maybe this is the reason they set their status to busy or offline.
In such cases, where the user might really not want to know what the other person is saying, your proposed suggestion might be annoying. A toggle messages on/off kind of thing would be cool.

The first part sounds cool in addition to your original suggestion, it should be added. There is already a system which blocked a user for a few seconds if they spam really fast.EDIT 2: 15-01-2011
Another addition to the chat is having some sort of signal or image next to the person's name, indicating whether or not they are in a game. This would let people know whether or not they can private battle and therefore there won't be any confusion as to knowing when someone is in-game or not.
Furthermore, another suggestion could be, in order to stop flooding, to have some sort of repetition sensor. This means that if a person floods the chat, whether in private chat or public, the person will get a message saying that they cannot post anything for a given amount of time.

I think it is has not been implemented in private chat, as I get spammed so much with the same sentence over and over. That's how I came up with that since it is really annoying and it happens non-stop with no break. Therefore, I thought it wasn't implemented.(...)

It has. It only works though if someone spams fast about 5 times, it doesn't block the person if they spam slowly though. If its someone you don't know or don't wanna talk to then you can always add them to the ignore list.(...)I think it is has not been implemented in private chat, as I get spammed so much with the same sentence over and over.
